Privacy Policy

This page explains, with no fine print, what personal data we collect on emignia.com, what we use it for, who we share it with and what you can do about it.

01Who is responsible for your data

Emignia is a brand of Grupo EMIGNIA SPA, a company incorporated in Chile. Grupo EMIGNIA SPA is the controller of the personal data collected on emignia.com, in its Spanish, English and Portuguese versions.

For any question or request about your data, write to hola@emignia.com. The same address is our contact point for data protection matters, including the data protection officer (encarregado) contact required by Brazil’s LGPD.

02What we collect, why and on what legal basis

We only ask for the data each feature needs. This is the complete list:

  • Contact form

    Data
Name, email and message. Company, phone and service of interest are optional.
    Purpose
Answer your inquiry and, if you ask, prepare a proposal. It arrives in our inbox.
    Legal basis
Your consent (form checkbox) and the pre-contractual steps you request.
  • Free SEO audit

    Data
Your website URL, your email and the result of the analysis.
    Purpose
Show you the result, send it to you and contact you about it. It is stored as a sales lead in a database on our own server.
    Legal basis
    Your consent (form checkbox).
  • AI chat

    Data
The messages you type and the page language.
    Purpose
Answer your questions. Messages go through our automation server (n8n, self-hosted) and are processed by an OpenAI model. The assistant has no persistent memory: it does not keep a history of your conversations.
    Legal basis
Your consent: the chat informs you up front, and sending a message is a voluntary action.
  • WhatsApp

    Data
Whatever you write to us on WhatsApp.
    Purpose
Answer your inquiry. The site only has a link: WhatsApp (Meta) does not load until you click it.
    Legal basis
Your consent and the pre-contractual steps you request.
  • Analytics

    Data
Cookie identifiers, pages viewed, device, browser, approximate location and, in Microsoft Clarity, recordings of how the page is used (clicks and scrolling).
    Purpose
Measure and improve the site with Google Analytics 4 and Microsoft Clarity.
    Legal basis
Your consent. Only active if you accept the “Analytics” category.
  • Advertising

    Data
Cookie identifiers and conversion events (for example, that you submitted a form).
    Purpose
Measure our campaigns and show ads to people who visited the site, with Google Ads and Meta Pixel.
    Legal basis
Your consent. Only active if you accept the “Advertising” category.
  • Spam protection

    Data
IP address and technical browser data, processed by Cloudflare Turnstile.
    Purpose
Prevent spam and abuse on the forms.
    Legal basis
Our legitimate interest in protecting the site and its forms.

We do not ask for sensitive data such as health information or bank details. Please do not include it in your messages or in the chat.

03Where the data comes from

You provide all the data directly, or your browser generates it while you visit the site. We do not buy databases or obtain your data from third parties.

04Who we share your data with

We do not sell your data. We only share it with the providers we need to run the site and, when the law requires it, with authorities. Google, Meta and Microsoft also process data under their own privacy policies.

    Purpose
Hosting for the site, the automation server and the audit lead database.
    Location
    Germany
  • Zoho Mail

    Purpose
Email: receiving form submissions and replying.
    Location
Outside Chile, depending on the account region

AI model that writes the chat answers.
    Location
    United States
  • Cloudflare

    Purpose
    DNS and spam verification (Turnstile).
    Location
    United States and global network
  • Google

    Purpose
Google Analytics 4 and Google Ads, only with your consent.
    Location
    United States
  • Meta Platforms

    Purpose
Meta Pixel (ads on Facebook and Instagram), only with your consent.
    Location
    United States
  • Microsoft

    Purpose
Microsoft Clarity (usage analytics), only with your consent.
    Location
    United States

05International transfers

As the table shows, most of these providers are outside Chile and Brazil, mainly in Germany and the United States, so your data may be transferred to those countries. We work with providers that publish their data processing terms, and we tell you about it here and on each form before you send us anything.

06How long we keep your data

We keep data only as long as it serves the purpose it was given for:

  • Contacts (contact form, SEO audit, WhatsApp and email): up to 24 months from the last contact, or less if you ask us to delete them. If you become a client, contract data is kept for the periods required by tax and commercial law.
  • Chat: the assistant keeps no history. OpenAI may retain requests for a limited time (up to 30 days) to detect abuse, under its business policies.
  • Analytics and advertising: according to each provider’s retention periods and our settings. In Google Analytics, 14 months at most. Each cookie’s duration is listed in the Cookie Policy.
  • Your cookie choice: 12 months. After that we ask again.

07How we protect your data

We use HTTPS across the whole site. Our servers are our own and access is restricted; the audit lead dashboard is password protected; forms have spam verification; and only the people handling your request can access your data.

No measure is foolproof. If an incident affects your data, we will notify you and, where required, the authorities.

08Automated decisions

The SEO audit automatically scores a website, not a person. We do not make automated decisions that have legal effects on you.

If you accept advertising cookies, Google and Meta may add you to audiences to show you ads (advertising profiling). You can withdraw that consent at any time.

09Your rights

Regarding your personal data, you have the right to:

  • Access: know what data we hold about you and how we use it.
  • Rectification: correct inaccurate or incomplete data.
  • Erasure: ask us to delete it.
  • Objection: ask us to stop using it for a given purpose, such as sales outreach.
  • Portability: receive it in a structured, commonly used format.
  • Restriction: ask us to temporarily suspend its use.
  • Withdraw your consent at any time, without affecting what was done before.

To exercise them, email hola@emignia.com saying which right you want to exercise and something that lets us identify you, such as the email you used. It is free, and we reply within the legal deadlines. If you are not satisfied, you can file a complaint with Chile’s Personal Data Protection Agency once it is operating, or with Brazil’s Autoridade Nacional de Proteção de Dados (ANPD) if you are in Brazil.

10Cookies

We use cookies that the site needs to work and, only if you accept them, analytics and advertising cookies. The details of each one (name, provider, purpose and duration) are in the Cookie Policy. You can change your choice at any time from “Cookie settings” at the bottom of every page.

11Minors

The site is aimed at companies and professionals. We do not knowingly collect data from people under 18. If we find that a minor has sent us data, we delete it.

12Legal framework

We process your data under Chile’s Law 19.628 on the protection of private life, currently in force, and Law 21.719, which amends it and takes effect on December 1, 2026. For people in Brazil we also apply the Lei Geral de Proteção de Dados (Law 13.709/2018).

13Changes to this policy

If we change this policy, we will update the date and version at the top of the page. If the change is significant, we will announce it on the site.
